Terms of Service

1. Acceptance of terms

By accessing or using LINKUP WIRELESS™ services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Service description

LINKUP WIRELESS™ provides month-to-month prepaid global travel eSIM data plans. Plans start at $39/month for 10GB, up to $179/month for Unlimited High-Speed Data (subject to a Fair Use Policy of 60GB). Service is delivered via our global network partners in 190+ countries.

Data-Only: Our service is strictly data-only. It does not include a native phone number, voice calling, or SMS. Users must utilize Over-The-Top (OTT) applications such as WhatsApp, FaceTime, or iMessage for communication.

3. Payment & billing

Payments are processed by Stripe on a recurring monthly (or annual) basis. You authorize LINKUP WIRELESS™ to charge your payment method each billing cycle until you cancel. You may cancel at any time through the Stripe Customer Portal. No refunds are provided for partial months.

4. Privacy & zero-knowledge architecture

LINKUP WIRELESS™ operates under a zero-knowledge architecture. We do not log, store, or have access to your browsing history, location data, call records, or message content. Our full privacy practices are detailed in our Privacy Policy, which is incorporated into these Terms.

5. Acceptable use & US network restrictions

You agree not to use the service for any unlawful purpose. "Unlimited" plans are subject to a Fair Use Policy (FUP) of 60GB of high-speed data. Extreme usage patterns may result in speed throttling or service suspension.

US Usage Restriction: The United States network is provided by our partners for temporary roaming usage only by international travelers. It is not intended to be used continuously as a replacement for a permanent local mobile subscription. If a user is flagged for continuous domestic usage in the US, the service may be suspended.

6. Service availability & performance

We strive to provide reliable service through multi-network coverage. However, coverage may vary by location and is subject to the network availability of our underlying carrier partners. We do not guarantee coverage in all areas.

7. Limitation of liability

Disclaimer of warranties: The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, LINKUP WIRELESS™ LLC disclaims all warranties, express or implied.

Limitation of liability: To the maximum extent permitted by law, LINKUP WIRELESS™ LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless LINKUP WIRELESS™ LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the service or your violation of these Terms.

9. Dispute resolution

Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Miami-Dade County, Florida.

10. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
